Disclaimer

Our goal at Play Naturally Occupational Therapy (OT) is to ensure everyone has a safe and enjoyable time, however, we need to let you know that there may be some risks involved, as with most outdoor activities. 

Nature is unpredictable, and being in nature can come with certain hazards, such as:

  • slippery or uneven ground, 
  • falling objects e.g., trees, 
  • exposure to weather, animals (including snakes), insects, & allergens, 
  • limited communication. 
  • no fenced boundary
  • small objects that children might put in their mouths

These hazards may result in physical injury, heat or cold-related illnesses, allergic reactions, or delayed emergency assistance. 

We (Play Naturally OT) have a plan to reduce these risks, but we can’t control everything that happens in nature. You are responsible for your own child/ children at all times. You are able at all times to make your own decision about you and your child/ children’s your level of comfortable participation and safety, or to choose to leave the event at any time (after notifying the facilitator). 

You are required to have completed the Participant Registration Form and in doing so advised the facilitator if you have any medical, health or functional concerns. By participating in our program/event, you agree to accept the risks and also accept responsibility for your own safety and wellbeing, as well as that of your child/ children. 

You agree to report any incidents or injuries to us on the day of the session/ event and to seek medical treatment if necessary. If you are unconscious or unable to make decisions, the facilitator may seek emergency medical treatment for you.  

By signing this document, you are also agreeing to release and forever discharge Play Naturally Occupational Therapy (OT) from any and all actions, lawsuits, claims and demands for, upon or by reason of any damage, loss or injury, which may be sustained from your participation in our programs/events. You should have adequate insurance coverage, or be willing to pay for any injuries or damages you may cause or receive. 

By participating in this activity, you certify that you have read and understood this document and agree to its terms. 

Terms and Conditions

This Terms and Conditions Form acts as a legally binding contract agreement between Play Naturally Occupational Therapy (OT) and yourself as a family participant in our services. The following are a sets of guidelines for you to become familiar with and sign your agreement to prior to being part of the Play Naturally OT Programs. 

Payments 

I agree to pay in full for a ticket to a Play Naturally OT program/ session/ event prior to attending. Tickets are available at https://playnaturallyot.com.au and all payments are via credit card online using Play Naturally OT’s attached secure Stripe account,. Prue may send me a direct invoice via Xero for payment, in this case I will make payment via bank transfer. If I bring more than 1 child with me to the session then I am required to purchase a ‘additional child’ ticket, even if my child is of a younger age than that of the nominated group. This is unless your younger child is an infant (under 6 months) and will remain in a carrier or pram for the duration of the session. If I am a new family and attending a termly program (either full term or 4-session pass) for the first time, I am required to purchase a ‘new family registration’ ticket on top of the termly ticket/ fee. If a specific invoice is required for claiming the cost of the program with funding such as NDIS, I will also need to purchase a ‘NDIS administration fee’ ticket also. 

Unwell Policy 

I agree not to attend a session if my child or myself are unwell and will notify Prue at Play Naturally OT as soon as possible, via text message on 0491 674 594. I am aware that I may be eligible for a make- up session within the term I missed a session. Prue also agrees not to attend sessions when she is unwell and will notify the families as soon as possible in this situation. 

Cancellation/ Make- ups Policy 

I am aware that Play Naturally OT is unable to refund tickets for cancellation, however they offer a ‘make- up’ session in the week following the program to compensate for any sessions missed during the term, or you may be able to join another class as an extra during the term is that suits. Missed sessions may be due to sickness, weather or an important specialist appointment for example, but simply forgetting or having other plans on the day will not be compensated for. 

Incidents and Hazards Policy

I understand the risks involved in being in open nature/ ‘bush’ outdoors as explained in the ‘Disclaimer Form’. If an incident occurs in our Play Naturally OT programs/ events or a hazard is identified, I will notify Prue Spry as soon as possible. Parent and Child Responsibilities Policy

I understand that Play Naturally OT provides sessions that aim to support connection between child and caregiver, amongst other aims. This therefore requires that I (or the child’s named carer) remain with my child/ children at all times. I understand I am responsible for the participation and safety of my child/ children at all times. As a carer/ parent I am required to participate in the sessions, and that I will not leave my child unattended. 

Weather Policy

I understand Play Naturally OT programs/ events are all held outdoors and that the weather is part of the nature connection experience. Sessions are unlikely to be cancelled due to the weather unless there is an event of extreme weather conditions, when sessions will be cancelled, relocated, rescheduled or refunded. These conditions may include:

  • Catastrophic Fire Danger
  • Extreme Fire Danger
  • Extreme heat – if the temperature is 36 degrees or higher
  • Thunderstorms

Safety is a priority for Play Naturally OT and if there are really adverse weather conditions forecast, Prue will monitor this and I will be notified by SMS at least an hour prior to the start of the session to let me know if the session is cancelled, relocated, rescheduled. I will then be eligible for a make-up session at the end of the term, or a refund may be possible.

I will be aware of the weather conditions for the day of the session and will dress myself and my child/ children sensibly and practically for the weather and outdoor play. I will bring everything we require to make ourselves safe and comfortable, including being sun safe and aware of the cold. I will ask for support to know appropriate attire if I am unsure. 

Belair National Park 

I understand sessions will be held in Belair National Park. I will not be required to pay to drive into Belair National Park, as this entry fee is part of my ticket purchase. On entering the National Park I will let staff know I am there for a ‘Play Naturally OT’ session, and I will be guided through without cost. If I hold a National Park pass I am able to use this to enter the park as an alternative, however I understand the cost of the program remains the same. I understand I am only admitted entry into Belair National Park when attending a ‘Play Naturally OT’ session. 

Privacy and confidentiality Policy

I understand that my child and my personal information is stored with Play Naturally OT on Halaxy.com. At Play Naturally OT we understand confidentiality and use Halaxy as it is a healthcare industry leader in data and privacy protection and transparency. With Halaxy, your data is backed up daily and protected by bank grade security and encryption here in Australia, meaning that your data is secure at rest and in transit (where they are only accessible via TLS/SSL). Your data is stored safely here in Australia. More information on Halaxy’s security information can be found at https://www.halaxy.com/article/security. I understand brief notes of attendance to session and participants experiences will be documented in Halaxy, to support ongoing development and adaptations in the program to be appropriate. 

I understand that Play Naturally OT also uses mailchimp.com for email subscriptions and WordPress via Go daddy for website development. 

Information Sharing Policy

I understand my family’s information is stored confidentially and I need to give consent for the sharing of this information with others. This is a legal requirement under the Privacy Act of 1988. Information cannot be disclosed or shared with others unless my consent is given. 

However, Play Naturally Occupational Therapy (OT), as per the SA Information Sharing Guidelines is required to share information if the person disclosing the information believes, on reasonable grounds, that the disclosure is necessary to: 

  1. divert a person from offending or harming themselves 
  2. protect a person or groups of people from potential harm, abuse or neglect 
  3. protect service providers in situations of danger 
  4. help service providers more effectively address risks to safety and wellbeing 
  5. alert other service providers to a person’s need for assistance. 

This information may be disclosed to the following services; SA Police, SA Ambulance (where emergency is required), CARL – Child Abuse Reporting Line, NDIS Commission. Further detail can be obtained from the SA Information Sharing Guidelines www.dcp.sa.gov.au If I have any questions or wish to discuss further, I can contact Prue at Play Naturally OT prior to signing and returning this form.

Intellectual Property

I understand that all materials, content, and resources and ideas used and provided through the sessions and events that my family and I attend, are the intellectual property of Play Naturally OT, and are protected by copyright and other applicable laws. I acknowledge there has been a lot of skills, experience and consideration put into these resources and I may not reproduce, distribute, modify, or create derivative works from any of our materials or content without prior written consent. My use of the services provided by Play Naturally OT does not grant the rights to the intellectual property. Play Naturally OT reserve the right to take legal action against unauthorized use of their content. By engaging with these services, I agree to respect and uphold these intellectual property rights.

I have read, understood and accept the above terms and conditions. By accessing and using Play Naturally Occupational Therapy services, I agree to comply with and be bound by these terms and conditions.  I understand that if I do not agree with any part of these terms, I must discuss this with Prue and not undertake services. I also understand that Play Naturally OT reserves the right to modify these terms at any time, and it is my responsibility to review them periodically, and that continued use of the services following any changes constitutes my acceptance.
